MY ORDER from The Old Rover (ISSUES) lost $500!

HI there ya' all hope things are well with you all...

I hope you guys can help me regarding this... I LOST $500 to The Old Rover.

back in August or September 2009 I was looking at some threads here saw that he was working on Mysterious Song which looked like an awesome home brew RPG and noticed a link to frozen utopia's website.

Sent him a PM inquiring him abo0ut Mytsterious Song , Neutopia III and one other unfinished game.

At that time I knew he mentioned that they were not finished games and he said that they were sitting and that the resources to get them completed would be costly I.E. CD printing and manuals cases etc etc and paying team members who worked on those games. He mentioned that Mysterious Song was about like 95% complete and Neutopia III was like 5% completed.

So since they were sitting and doing nothing I made an offer to him to buy them and he said he has discussed with other team members who has been working on them and they all approved it so I made an offer of $500.

So I was thinking about it and went ahead and commited to the purchase and I sent him like 2 or 3 payments totalling of $500. Last payment was made in October maybe November will have to look in my paypal account. So it was paid in full of $500.

He said he needed the money ASAP he was in the verge of losing his home I felt so bad so I sent him payment that would be able to help him. And after I started making payments to him I noticed that the team got ACTIVE on working on Mysterious Song again after long hibernation which is GREAT I wanted that game to be available to us for us all to purchase.

The Old Rover said many thanks for the final payment installment and said he would be sending me total of about 19 or more discs (that was back in October or November of 2009) so I said okay great am looking forward to it and Never heard back from him ever again so finally on 1/8/2010 I sent him a PM said sorry I was extremely busy with other things I.E. work and family etc.. and holidays and was out of state on vacation. I sent him the PM asking him what is the update and status on this. ??? He quickly replied to me he said he has shipped them out to me and he has never heard back from me and that he assumed that I have received them.

BUT I have never received anything from him at all in the mail so I sent him another PM yesterday saying that I have never received anything at all and would like photocopy of the postal receipt and tracking number and he has not replied back to me on this so I had no choice but to bring it up to the PUBLIC here. I will be more than happy to delete this thread if I get my REFUND. Here are some reasons why I want a REFUND because I have never received the discs at all.

I wanted to order the Special Version of Mysterious Song with special item he told me not to worry about that and said that I am on the list which I hope I am!

anyways here are reasons why I would like to get a REFUND or the items I was promised )19 or more discs of Mysterious Song...Neutopia III and other game that the team was working on.

I lost $500.

He told me that he has received several offers on the 19 or more discs which I wonder if the other buyers has received them some of their offers were better than mine so that is why I am wondering if they have gotten the discs and not me ?

1 offer was lots of PC ENGINE Games by a different buyer.

1 offer was $800 by a different buyer.

1 offer was Sega Saturn with lots of games by a different buyer.

I have never received the discs at all since October or November 2009 and Puerto Rico is not far away from here.

and I have never received a PM from him saying that they have been shipped out I had no clue until I sent him a PM asking him what is the update on this and his reply was oh he shipped them out and he assumed that I have received them already but I have never received any of it at all. So now here I am out of $500 and the items he promised to ship to me...

I am sure he is a honest seller just hope something gets done about this thanks !

I have tried to keep it all private via PM but he has not replied back to me so that is why i got so concerned hope he will reply me back and work things out with me.

UPDATE as of 1/13/2010

The Old Rover has been better at replying back n forth thru PM so hopefully we will get this settled.

I asked him for photocopy and proof of Delivery Confirmation and Postal Office receipt that he has shipped out. His Response was that he threw away the Delivery Confirmation slip.

And he said he is not sure what he could do about this at first. But He said he went to his shipping company that he uses to ship out his stuff he said the package was still there it was delivered to a wrong address then got returned to his shipping company that is what he said.

He said he will try and get them shipped out to me ASAP he has been busy lately. So hopefully I receive the stuff what I have paid for and once I receive the items I will let you all know and to have this thread closed or deleted.

for those of you who ordered Mysterious Song am sure you guys will receive them when they are ready.

So will keep this thread updated and keep you guys updated. Thanks for your support and concerns...

UPDATE AS OF JANUARY 20 2010
UPDATE:

The Old Rover said he would try and ship them out last Thursday but got tied up with other things and that he would try and ship them out on Friday in San Juan but I have never heard back from him ever since so .. am keeping you guys informed and updated on this situation thanks.

UPDATE AS OF JANUARY 25 2010

I have Received the discs as promised so will need to test them to make sure they all work and then I will close this THREAD ! The Old Rover is good in my books. I do not mind about late shipping i am a very patient person myself but I was scared that I was out of $500. But now since I have received the discs will need to test them and then if everything works as promised then I will close this thread. And hey there The Old Rover please do not leave this community no one is perfect people do make mistakes and sometimes they get too busy and forget about shipping. So hope you decide to stay in this community and continue contributing to the pc engine and turbografx community !

IIRC this was for a bunch of the proto discs..not the finished released game.

I know Old Rover use to be a regular here but the decent thing to do now is to come on and tell his side of the story.

I dont really know Old Rover but Someone complaint against him and nobody cared? As for me. I reordered and Older Rover had messaged me that he s still working on it but that was a month or two ago. Surprised that Old Rover did not read this. I ll copy and paste and send out to Old Rover and see what is his side story to prevent any munderstood or fraud. I hate to see everybody buying excitement for nothing (hope not). I had seen the preview of Mysterious Song. It s a must to release ASAP!!!..

Old Rover.. Please try to solve this issue to save more customers from suspecious or munderstooding. There is plenty customer who is in middle of buying your product or not. Hope you would be able to clear this out. =)

well, The Old Rover is pretty busy with his family and financial situations right now. That's most likely the reason for his absence around here. Kind of like your long delay between paying, and starting this thread.

I am sure a tracking number of some sort can be located and everything will clear itself up.

Patience and understanding are important.

And yes, this was all for prototype discs. Not the full games.

Maybe his delay between paying & posting was giving benefit of the doubt. Many of us know Rover's busy, etc..yet he has been on at least 2-3+ times since this has been posted...so a response/tracking # should have already been forthcoming. Oct/Nov to Jan IMO is more than patient.

This was more a generalized statement. Some of you know Old Rover personally so a "Hey I called or emailed Rover on this" would've been a nice gesture. What about the rest of the devs on MS? No comment? Come on man, in the past when someone was perceived to have a problem people came out and at least HELPED in some way by moving the communication along. I agree that we shall see, but at this point he supposedly has been on a few times and can't take the time to publicly make a statement about providing a tracking number or better yet, saying something that causes this thread to go away? That was my point, I don't expect someone to flame Rover, or the OP, that would be not cool.

Here I am.

Well, here's what happened...as most of you know, I often use a shipping company to send out orders when things get hectic. Well, things have been hectic as hell for the last six months, so any orders I've sent have been through them. This order in particular was shipped out over a month ago. However, they sent it to the wrong address, and it was returned. Because the package was actually delivered, the DC said that it was delivered. But the person at that address sent it back. It was returned to the shipping company. They know me very well there, and know that I ship a lot of stuff. So what they did was they hung onto the package and basically sat on it until I came in for the next shipment. Well, I haven't had anything to ship since then, and they sort of "forgot" about the package until I called them up to find out if anything was amiss. They told me what happened. Earlier today, I stopped over there to pick up the package, and will be mailing it out personally tomorrow.

This isn't the first time they've fucked up an order, but this is probably the most severe fuckup. Though out of about six hundred or so orders I've sent through them, this is fuckup #4. I guess that's not bad for a half-wit shipping company based in Puerto Rico.

It's honestly not any of our business. It should all just be solved via PM's. I am just assuming you are wanting to keep us in the loop in case some of us want to order so we know what to expect, but this all should be done through PM's.

This is no different than any # of other topics warning/bringing to light "deal problems". It seems when it started there was no/little communication even thru PM's, hence the thread.

Agreed. Obviously Dalder is worried about the $500 he spent when he hasn't received items. If PMs were working he wouldn't about brought this to light in a forum post. Can't really fault the guy.

Haha, I may be a meatsack but I'm not actually all that angry. I just thought Rover needed a dressing-down since everyone gave him the benefit of the doubt by keeping quiet, and that *still* wasn't good enough for him. My request for him to come back was earnest, because people around here seem to like the guy and therefore he's important to the community, but he's behaving like a prima donna and I'm going to call him out on that. Because I want to.

If everyone thinks it was appropriate for Rover to get offended by this thread and quit posting at PCEFX, then speak up, call me a mean angry man, whatever. Everyone's allowed to have an opinion. But if Rover's behavior was truly appropriate, then he won't be back because his departure would therefore be justified. It's a catch-22!

??? This thread was posted by a (rightfully) concerned person that thought they were out $500, with lack of communication. Emerald Rocker makes some good points...this was handled with kid gloves, and was more civil than ANY similar thread of it's type in years. You don't see venom spewing in posts, people now questioning what will happen with Mysterious Song, etc.

Gotta face some issue and solve and move on. It s like when you live in a town and u find a neigbor who pissed and calls for everyone to look out and have a simple meeting. I would brief and solve the problem and move on instead of brief, solve the problem then move out of town!.

But Rover felt that is childish which i cant blame.

$500 is alot to me and i would speak up cuz it s lead to big market soon.

Glad Rover solved this problem and move on thos.. this issue might be small to him cuz he know he will be in big business due to new game =)

When was the last time that a long standing member had any troubles, Dean? Well yes, I was given the benefit of the doubt by many. Not that I even deserved it necessarily. I was pretty much AWOL for a while. Michael was on the case on that one and as I said then, it's good there's people here that will keep on task with deals like this. I have no problem with threads like this as long as they remain civil.

If I was one of the people who placed an advance order on Mysterious Song (I'm not)- I'd be concerned that Rover's disappearance would mean either that the game will never be delivered or that Rover will fall out of contact with updates on the game's release coming to a halt. Rove- this is not the effect you desire. Nothing much happened here- a guy rightfully questioned on the whereabouts of his purchase- and you came on and set it straight. No reason to run- as I stated if you do turn and leave now it will only be the cause of more concern. It would do you good to keep showing your face until the game is released- this way no one can say you're taking the money and running.

Rover was creating drama/playing the "victim" when there was absolutely no reason to do so. I hold no ill will towrads him (as it seem no one else does either). MAYBE peeps are concerned on WHAT has been keeping him away so much, especially as he was on regularly somewhat recently , and MS is supposed to be releasing in a bit over a month.
